1. Scope and seller

These general terms and conditions apply to all orders placed through our online shop at www.a-scheiwesch.com, by phone or by email, and to registrations for our bread-baking courses.

Our offer is aimed at consumers and businesses. The contract languages are English, German and French.

2. Conclusion of the contract

The products shown in the online shop are not a binding offer but an invitation to order. By clicking the button to complete your order, you make a binding offer to buy the items in your cart. Before submitting, you can check and correct your details at any time.

You will immediately receive an automatic confirmation by email. The contract is concluded with this order confirmation. If a product is exceptionally unavailable, we will inform you without delay and refund any payments already made.

We store the contract text (your order details and these terms). You receive your order details by email; these terms can be viewed and printed on this page at any time. If you have a customer account, you can also see your past orders there.

3. Prices and deposit

All prices are final prices in euros. There are no shipping costs, as we sell for pickup only (see section 4).

For products in returnable jars (such as honey), we charge a deposit of €1.00 per jar, shown separately. The deposit is refunded as soon as you bring the jar back.

4. Order deadlines and pickup

We do not deliver; all orders are collected. When ordering, you choose a pickup location and a pickup day:

  • Moutfort (bakery, 30, rue d’Oetrange, L-5333 Moutfort);
  • Melusina;
  • Teranga.

Pickup days and times depend on the pickup location and are shown when you order; only possible days can be selected in the pickup calendar.

Bread orders must reach us by 12 noon on the day before the chosen pickup day, as every loaf is baked fresh for you. Same-day pickup is not possible. No pickups are possible on public holidays or during our closing periods; these days are blocked in the pickup calendar. Some products may have specific baking days, which are shown when you order.

Please collect your order on the chosen day within the opening hours shown. Orders that are not collected must still be paid, as they were baked specially for you.

5. Payment

You can choose between:

  • cash on pickup;
  • bank transfer: our bank details are included in the order confirmation. Please use your order number as the payment reference. The transfer must reach our account before pickup.

6. Right of withdrawal

Exclusion for fresh bakery products: there is no right of withdrawal for goods that are liable to deteriorate or expire rapidly (Art. L.222-9 of the Luxembourg Consumer Code – Code de la consommation). This applies in particular to bread, cakes and other fresh bakery products.

Exclusion for courses: there is also no right of withdrawal for services related to leisure activities where the contract provides for a specific date or period of performance (Art. L.222-9 Code de la consommation). This applies to our bread-baking courses; section 7 applies to them.

For all other goods (for example flour, honey and other non-perishable products), consumers have the following right of withdrawal:

Withdrawal information

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier indicated by you, acquire physical possession of the goods.

To exercise the right of withdrawal, you must inform us (A Schéiwesch, François Kieffer, 30, rue d’Oetrange, L-5333 Moutfort, Luxembourg, phone +352 691 499 021, email info@a-scheiwesch.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal: if you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them back to us at our bakery in Moutfort without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

The right of withdrawal also does not apply to sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

7. Bread-baking courses

A course registration is binding once we have confirmed it by email. The course price, currently €360 per person for the whole course, is payable at the first session. The number of participants is limited; places are allocated in the order in which registrations are received.

Cancellation is free of charge up to one week before the first session. After that, cancellation is no longer possible and the full course price is due; you are welcome to send someone else in your place.

If we have to cancel a course (for example due to illness or too few participants), we will offer you another date or refund any amounts already paid in full. Any further claims are excluded to the extent permitted by law.

8. Warranty and complaints

The statutory warranty rights apply (legal guarantee of conformity under Art. L.212-1 et seq. of the Code de la consommation and the guarantee against hidden defects under Art. 1641 et seq. of the Civil Code). As our bakery products are fresh, please check your goods briefly on pickup and report any complaint immediately if possible, or at the latest the following day, so that we can replace them quickly. This does not affect your statutory rights.

Our bread is a natural product, baked without additives in a wood-fired oven. Slight differences in shape, size, colour and weight compared with the pictures are therefore part of the craft and not a defect.

9. Allergens

Our products are made in a bakehouse that processes cereals containing gluten, seeds, nuts and other allergens, so traces cannot be ruled out. Information on the allergens contained in each product is available on request at the bakery, by phone or by email.

10. Liability

We are liable without limitation for damage resulting from injury to life, body or health and for damage caused intentionally or through gross negligence. Otherwise, we are only liable for breaches of essential contractual obligations, limited to the foreseeable damage typical of the contract. Mandatory statutory provisions, in particular on consumer protection and product liability, remain unaffected.

12. Dispute resolution

The Service national du Médiateur de la consommation is responsible for the out-of-court resolution of consumer disputes in Luxembourg (6, rue du Palais de Justice, L-1841 Luxembourg, phone +352 46 13 11, mediateurconsommation.public.lu).

13. Applicable law and jurisdiction

Luxembourg law applies. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence. If the customer is a business, the courts of Luxembourg City have jurisdiction.

Should any provision of these terms be invalid, the validity of the remaining provisions shall not be affected.
